Apple Appeals To The Federal Court After White House Declined To Veto Watch Ban

After the United States president’s office declined to reverse the Apple Watch Series 9 and Watch Ultra 2 import/sale ban in the region, Apple appealed the decision with the federal court on Tuesday. According to a Reuters report, the company has asked the Federal Circuit to halt the ban until January 12, 2024, when the United States Customs and Border Protection decides whether the redesigned versions still infringe on Masimo’s patents.

Apple Is Taking Measures To Bring Back Its Latest Smartwatches

In a statement quoted by the agency, Apple says it strongly disagrees with the USITC decision and is taking all the measures to return the Apple Watch Series 9 and Watch Ultra 2 to customers in the United States. Although experts suggest that it isn’t unusual for the ITC to issue an exclusion order, it is uncommon for Apple to accept the ban instead of making efforts to settle.

The Concerned Models Include Patented Technology

The United States International Trace Commission decided to ban the Apple Watch models in October over an infringement involving the blood-oxygen measurement tech. This particular order came from a complaint filed in mid-2021 by Masimo Corp. Back then, Apple said that the company wrongly attempted to use the International Trades Commission to keep a life-saving product from United States consumers “while making way for their own watch that copies Apple.”

However, it is important to mention that the ban only applies to the United States market, implying that both Apple Watch models are available overseas, including markets like India.
